General Terms and Conditions for the Long Night of Applications

§ 1 General

These General Terms and Conditions (GTC) exclusively apply to the event “Long Night of Applications” organized by Doria Pfob and participation in it. Unless expressly agreed in writing by the organizer, no other or conflicting terms and conditions of participants, companies, and event partners will be considered part of the contract, even if they are not explicitly rejected by Doria Pfob and her team. The scope of the GTC covers the period of the contractual relationship between Doria Pfob and the participants. It also includes all services arising from participation in the “Long Night of Applications.” The GTC apply equally to participants, trainers, technical advisors, participating companies, and all involved partners.

§ 2 Registration, Prices, Contract Conclusion, Payment, and Cancellation

Participating companies, sponsors, press and media, partners, venue partners, trainers, and all participants are considered contractual partners for the “Long Night of Application.”

The contract between participating companies and Doria Pfob MSc is concluded by confirming their registration. This confirmation is sent in writing via email from Doria Pfob and her team to the companies. The prices for company and sponsor participation are based on the respective package choice. By concluding the contract, companies agree to transfer the participation fee or sponsorship contributions for the “Long Night of Application” within two weeks of receiving the invoice and accept the GTC. If companies or sponsors do not pay on time or fail to pay, Doria Pfob MSc reserves the right to charge default interest of 10%. In case of cancellation by companies (withdrawal or cancellation of participation), the participation fee or sponsorship cannot be refunded unless specifically agreed with Doria Pfob MSc in advance. The participating company is not entitled to rent or transfer its place to third parties.

Participation for applicants in the “Long Night of Application” is free of charge. Participants, i.e., applicants, do not need to pay any contribution to participate. By registering for the “Long Night of Application,” participants agree to the GTC and GDPR. The contract between Doria Pfob MSc and the participants is concluded only upon confirmation of the registration by Doria Pfob MSc or her team. Thus, they are obligated to attend and participate on the day of the event as intended.

Applicants can only register through the website (www.langenachtderbewerbung.com). Double registration is not possible. If a person registers multiple times for the event as an applicant, the latest registration will be considered valid. All other registrations will be deemed invalid.

§ 3 Allocation of Places

The organizer provides companies with one or more tables and a place for the future dates. There is no claim to a specific table. At each table, one representative from the participating company can conduct a conversation with an applicant. Multiple HR representatives from a company can alternate, but the change must not cause any delay in the conversations.

§ 4 Behavior Rules at the Event

Companies, unless a sponsor or partner contract with Doria Pfob MSc has been concluded, are not allowed to actively advertise with any promotional materials at the “Long Night of Applications” – neither for themselves nor for a third party. In this case, Doria Pfob MSc reserves the right to impose a contractual penalty of €4,000.00 (four thousand euros).

If a participating person, company, or event partner behaves indecently or illegally at the “Long Night of Applications,” they will be excluded from the event. The same applies if their behavior has a harmful effect on the event. Doria Pfob MSc reserves the right to claim damages in addition to this.

Participants are required to actively contribute to the event. If participants do not engage and actively participate (e.g., not preparing for interviews, not contributing positively to group exercises, distracting others from their work) or even work against the event, they may be excluded by Doria Pfob MSc.

The appointed trainers who are provided for support during the Long Night of Applications must actively contribute to the event. There is also an obligation to be present on the day of the event. Trainers may be excluded from the event due to harmful behavior or other obstruction. They must follow the instructions and guidance of Doria Pfob and may only support the applicants in her interest.

All participating companies, event partners, trainers, and participants/applicants must adhere to the house rules/terms of use of the event venue.

For the Long Night of Application “Online Edition,” the following applications/platforms will also be used during the event:

Please note that the respective terms of use of these platforms apply and must be observed by all participants. The platform may be changed by the organizer at any time.

§ 5 Ownership & Copyrights

The copyright of the Long Night of Application lies with Doria Pfob MSc, Graz. This event, including all its parts, is the intellectual property of Doria Pfob MSc. Any use beyond the narrow limits of copyright law without the organizer’s consent is not permitted and is punishable.

Intellectual Property, Idea Submission & Awards

At the Long Night of Application Tourism event, participants can submit ideas on current issues published by participating companies as part of the event. The “Long Night of Applications Tourism” thus holds an idea competition at each event (represented by founder Doria Pfob) to create a nationwide idea pool (platform) for tourism.

All rights to intellectual property regarding the ideas published during the event remain with the rightful owners. However, the submitters grant the Long Night of Applications (Doria Pfob) a free, unlimited license for all types of utilization, including the right to use it in online networks. All submitted ideas are included in the idea pool for tourism and are visible to all existing and future participants of the “Long Night of Application Tourism.”

Participating companies may set rewards/prizes to be awarded at the end of the event to submitters if an idea appeals to the company and meets its expectations. The choice of reward or prize and the number of submitters who receive something is at the discretion of the participating companies. The organizer Doria Pfob only provides the opportunity for awarding prizes within the event. The submission itself does not create any legal claim (of any kind), regardless of whether the idea is awarded or not.

All submitters must ensure that their idea and the related submission (text, images, videos, etc.) were created independently. If external material is used, submitters must also ensure that it may be used. Submitters also agree that their submission(s) may be visible and accessible to all participants (applicants, companies, LNDB team, etc.) during the event.

All participating companies agree by participating that their submitted problem(s) are visible and accessible to all participants (applicants, companies, LNDB team, etc.) and may be communicated beyond the event, e.g., for newspaper articles, analyses, etc.

No liability is assumed for competitive or copyright infringement behavior by participating individuals and companies.

§ 6 Reservations, Changes in Event Program

Any changes to the program of the “Long Night of Applications” (e.g., changes in the venue, organizational changes, times, duration affecting the event, etc.) can be made by Doria Pfob MSc, even at short notice. The number of participants and the number of participating companies can also be changed by Doria Pfob MSc at any time. In case of a complete cancellation of the event by Doria Pfob, no claims for damages by participants, event partners, trainers, or companies can be made against Doria Pfob. Only the paid participation fee, minus any services already provided, will be refunded.

This excludes changes due to extraordinary events, such as force majeure, which were not caused by the organizer.

Should the event be converted into an online edition (application calls or video calls) due to force majeure, companies, event partners, participants, and trainers are responsible for choosing the video/call provider. We only provide a list of known providers. The use of these services is the responsibility of each individual. Doria Pfob also does not guarantee their functionality.

A change from a LIVE event to an online edition due to force majeure is not considered a cancellation. In this case, all services for participating companies and event partners will be provided digitally.

The contract remains in effect.

§ 7 Success Guarantee

A success guarantee cannot be given! The success of the application interviews at the “Long Night of Applications” depends on the applicants and companies themselves. The tips and advice provided by Doria Pfob MSc and her team are merely recommendations and not binding instructions. These recommendations can only be applied by the participant at their own responsibility.

Companies cannot be guaranteed a fixed number of future dates/application interviews! If no one applies to a company, attempts will be made to allocate interviews with applicants, but Doria Pfob MSc cannot be held responsible for whether these are attended by the applicants.

Participants/applicants have no claim to an employment relationship following their participation and application interviews. A fixed number of future dates/application interviews cannot be guaranteed to participants/applicants either.

Participation by companies, event partners, trainers, and participants/applicants is at their own risk and responsibility.

No liability is assumed for further steps between companies and applicants outside of the event, and these are at their own risk and responsibility.

§ 8 Personal Data, Photos, and Filmmaterial

The rules of the GDPR apply. Photos are taken and published during the event. Additionally, the participating person agrees that the resulting photo and video material may be used freely for and during the event. This material may also be used for advertising future events by Doria Pfob MSc. The participating person also agrees that the photos may be published on the social media channels of the Long Night of Applications, on the Long Night of Applications website (www.langenachtderbewerbung.com), or in other media (e.g., newspapers) for publicity purposes. This also applies to the Online Edition (the image and text material voluntarily provided by participants, companies, and event partners in Discord can be used for advertising purposes within the Long Night of Applications (e.g., recap video, promotional brochure, quotes including names, etc.) by Doria).

Partner companies agree by participating that their company name and logo (or word-image mark) are also available for unrestricted use.

§ 9 Jurisdiction & Legal Venue

The competent jurisdiction for all disputes arising in the context of the “Long Night of Applications” with partnership contracts and GTC is Graz City. For all legal relationships between Doria Pfob MSc and the contracting parties, Austrian law exclusively applies. The German text is binding for all contractual documents.

§ 10 Completeness and Accuracy

All agreements, approvals, and verbal side agreements must be in writing to be effective. Doria Pfob MSc is only responsible for organizing the event. No liability is assumed for the quality of the application interviews or for any failures by companies or participants. No liability is assumed for the course and content of the “Long Night of Applications.”

Furthermore, no liability is assumed for the accuracy and completeness of the information provided in the presentations. Participants cannot claim specific content of the program or company.

Trainers may only use Doria Pfob’s application strategies and methods outside the context of the Long Night of Applications with reference to “I-Marke and/or Application Method according to Doria Pfob.” Trainers and technical advisors are not permitted to process the resumes and data of the applicants within the framework of the Long Night of Applications.

Doria Pfob MSc assumes no liability for loss or damage to items and equipment brought by participants. No liability is assumed for personal injury either.

The terms of use and house rules of the respective event venue of the Economic Chamber and Wifi Graz, Vienna, Linz, and Klagenfurt apply.

All personal designations on the entire website and in all texts and relevant documents published in the context of the Long Night of Applications apply to all genders.
